These Terms and Conditions ("Terms") constitute a binding agreement between you ("you" or "User") and Star Solutions, LLC, doing business as Bud Bazaar Pro ("Bud Bazaar Pro," "we," "us," or "our"). These Terms govern your access to and use of our website located at BudBazaarPro.com (the “Site”), including all services, features, and transactions conducted through our online marketplace (collectively, the “Services”).
By accessing or using our Site or Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Site or Services.
1. Modification of Terms
Bud Bazaar Pro reserves the right to modify, update, or revise these Terms at any time. Changes will become effective upon posting on the Site. Continued use of the Services after such changes constitutes your acceptance of the revised Terms.
2. Eligibility and Compliance
You must be at least twenty-one (21) years of age and legally authorized to purchase cannabis-related products in your jurisdiction to access or use this Site. You represent and warrant that you meet this age requirement and that all information provided by you is truthful and accurate.
3. User Accounts
To access certain Services, you may be required to register an account. You agree to:
* Provide complete and accurate information during registration.
* Maintain the confidentiality of your login credentials.
* Notify us immediately of any unauthorized access or security breach.
You are solely responsible for all activity that occurs under your account.
4. Use of the Site and Prohibited Conduct
You agree to use the Site and Services only for lawful purposes. You shall not:
* Violate any federal, state, or local law, including cannabis regulations;
* Interfere with the operation or security of the Site;
* Use the Site to distribute, post, or transmit any unlawful, harmful, defamatory, obscene, or otherwise objectionable content;
* Attempt to gain unauthorized access to other user accounts or systems;
* Engage in scraping, harvesting, or other data extraction methods.
5. Marketplace Role and Vendor Disclaimer
Bud Bazaar Pro is a third-party marketplace that facilitates transactions between Vendors and Users. Bud Bazaar Pro is not a seller, manufacturer, distributor, or party to the contract for sale between Vendors and Users. Vendors operate independently and are solely responsible for:
* Product listings, descriptions, pricing, and legality;
* Order fulfillment, shipping, and customer service;
* Compliance with applicable cannabis and consumer protection laws.
Bud Bazaar Pro disclaims any responsibility for the quality, legality, accuracy, or delivery of products sold on the Site.
6. Product Listings, Pricing, and Availability
All product listings are provided by third-party Vendors and are subject to availability. We do not guarantee the accuracy of product descriptions or inventory levels. Prices are set by Vendors and may change without notice. Taxes and shipping charges will be calculated at checkout.
7. Order Acceptance and Payment
When you place an order, you agree to pay all applicable charges, including product prices, taxes, and shipping fees. All payments are processed through secure third-party payment processors. Bud Bazaar Pro does not store or have access to full payment card information.
8. Restricted Products and Cannabis Compliance
You acknowledge that some products sold on the Site may be cannabis, hemp-derived, or otherwise restricted under state or federal law. You are solely responsible for ensuring that the products you purchase are legal in your jurisdiction and for complying with all applicable laws. Bud Bazaar Pro does not ship, handle, or store cannabis products. We do not guarantee the legal status of any product outside of the jurisdiction in which it is sold.
9. Age and Identity Verification
Certain Vendors may require age or license verification to complete your purchase. By using the Site, you agree to submit valid identification upon request. Failure to comply may result in order cancellation or account suspension.
10. Intellectual Property
All content on the Site, including text, graphics, logos, images, videos, and software, is the property of Bud Bazaar Pro or its licensors and is protected under applicable copyright, trademark, and intellectual property laws. You may not use, copy, reproduce, modify, or distribute any content without our prior written consent.
11. Termination and Suspension
We reserve the right to suspend or terminate your access to the Site or Services at any time, with or without notice, for conduct that we believe violates these Terms, applicable law, or our platform integrity.
12. Indemnification
You agree to indemnify, defend, and hold harmless Bud Bazaar Pro, its affiliates, officers, agents, and employees from any claims, losses, liabilities, expenses, or demands (including attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or rights of a third party, including Vendors.
13. Limitation of Liability
To the fullest extent permitted by law, Bud Bazaar Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Site or any products purchased through it. Bud Bazaar Pro’s liability to you for any cause of action shall not exceed the amount paid by you to us in the three (3) months preceding the event giving rise to the claim.
14. Dispute Resolution and Arbitration
You agree to first attempt to resolve any dispute informally by contacting us. If a resolution cannot be reached, any dispute shall be resolved exclusively by binding arbitration in Oklahoma County, Oklahoma, in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or class action.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to conflict of law principles.
16. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, the remaining provisions shall remain valid and enforceable.
17. Entire Agreement
These Terms, along with our Privacy Policy and Shipping/Refund Policy, constitute the entire agreement between you and Bud Bazaar Pro regarding the use of the Services and supersede any prior or contemporaneous agreements.
