Shipping, Return, and Refund Policy
Effective Date: May 1st, 2025


This Shipping, Return, and Refund Policy (“Policy”) governs all transactions made on Bud Bazaar Pro (“Bud Bazaar Pro,” “Marketplace,” “we,” “us,” or “our”) and applies to all purchases from third-party vendors (“Vendor(s)”) operating storefronts on our platform. By using the Marketplace or placing an order, you (“Purchaser,” “you,” or “your”) agree to the terms and limitations set forth herein.


Bud Bazaar Pro serves as a neutral e-commerce platform facilitating transactions between independent Vendors and Purchasers. Bud Bazaar Pro is not the seller, distributor, manufacturer, or shipper of goods offered on the platform and assumes no liability for issues arising from individual Vendor transactions.


1. Shipping Policy


1.1. Vendor Fulfillment and Title/Risk of Loss Disclaimer
All products sold on Bud Bazaar Pro are fulfilled directly by third-party vendors. Bud Bazaar Pro does not warehouse, ship, or hold title to any goods and is not the seller of record. Vendors are solely responsible for packaging, labeling, and shipping products in compliance with all applicable federal, state, and local laws, including those governing cannabis and restricted goods.


Unless expressly agreed otherwise, title and risk of loss pass to the purchaser in accordance with the Uniform Commercial Code. Under UCC §§ 2-401, 2-503, and 2-509, for shipment contracts, title and risk transfer to the purchaser upon delivery to the carrier. For destination contracts, they remain with the vendor until delivery at the specified location.


Bud Bazaar Pro disclaims all liability for loss, damage, or delay once goods are tendered to the carrier. Purchasers are responsible for providing accurate delivery information and reviewing vendor-specific terms before purchase.


1.2. Shipping Methods and Timelines
Estimated delivery windows and shipping costs will be provided by the Vendor at the time of purchase. Bud Bazaar Pro makes no representations regarding shipping timelines or carrier performance. Vendors must act in good faith and adhere to reasonable commercial standards per UCC § 1-304.


1.3. Tracking and Delivery
Where applicable, Vendors shall furnish tracking numbers or shipping confirmation. Purchasers are responsible for monitoring delivery status and coordinating receipt of goods. Any claims regarding non-delivery must be directed to the Vendor within the time frame specified in the Vendor's policy.


2. Return Policy


2.1. Vendor Policies Govern
Bud Bazaar Pro does not set or enforce return policies for Vendors. Each Vendor establishes its own return and exchange terms, subject to the requirements of the Oklahoma Consumer Protection Act and the FTC’s “Mail, Internet, or Telephone Order Merchandise Rule” (16 C.F.R. Part 435). It is the Purchaser’s responsibility to review the return policy posted by the Vendor prior to purchase.


2.2. Initiating a Return
To initiate a return, Purchasers must contact the Vendor directly using the contact information provided on the Vendor’s storefront. Returns must be completed in accordance with the Vendor's posted return procedures, including timelines and condition requirements.


2.3. Return Abuse
Bud Bazaar Pro and/or the Vendor reserves the right to deny returns from Purchasers exhibiting excessive or abusive return patterns.


3. Refund Policy


3.1. Vendor-Issued Refunds
Refunds are administered solely by the Vendor in accordance with their refund policy. Once a return is accepted, the Vendor shall issue a refund to the original payment method. Bud Bazaar Pro does not issue or control refunds.


3.2. Processing Timelines
Refund timelines vary by Vendor and payment processor. Purchasers should allow a reasonable time frame for processing, typically 5–10 business days after Vendor approval.


3.3. Chargebacks and Disputes
Purchasers agree not to initiate chargebacks without first attempting to resolve the issue with the Vendor. Vendors are responsible for managing chargebacks and Bud Bazaar Pro disclaims any liability related to such disputes.


4. Cannabis and Regulated Products Disclaimer


4.1. Regulatory Compliance
Products listed on Bud Bazaar Pro may include cannabis, hemp-derived goods, smoking accessories, and paraphernalia. Vendors are solely responsible for ensuring that all listed items comply with federal law (including the Controlled Substances Act, 21 U.S.C. § 801 et seq.), state medical or adult-use cannabis statutes, and any local ordinances governing cannabis-related commerce.


4.2. Federal Law Disclaimer
Cannabis remains a Schedule I substance under U.S. federal law. Transactions involving cannabis or cannabis-derived products are not legal under federal law, even if permitted under state law. Bud Bazaar Pro does not ship, store, or possess any cannabis products and operates solely as a neutral online platform.


4.3. Age Verification
By placing an order, Purchasers affirm they are at least 21 years of age (or the applicable minimum legal age in their jurisdiction). Vendors are solely responsible for implementing and enforcing age verification at the point of sale and delivery.


4.4. Shipping Restrictions
Not all products are legal to ship across state lines or internationally. Purchasers are solely responsible for ensuring that the products they order are legal in their delivery jurisdiction. Bud Bazaar Pro disclaims any liability for seized or non-delivered packages due to regulatory violations.


5. Limitation of Liability
Bud Bazaar Pro is not a party to the transaction between Vendor and Purchaser. Under no circumstances shall Bud Bazaar Pro be liable for damages, including but not limited to lost profits, loss of data, or consequential, incidental, or punitive damages, arising out of or related to shipping delays, product defects, returns, or refunds.
Purchasers agree to hold Bud Bazaar Pro harmless from any claims, damages, or liability arising from purchases made through the Marketplace, except as required by law.


6. Force Majeure
Bud Bazaar Pro and its Vendors shall not be liable for delays or failures in performance resulting from events beyond their reasonable control, including but not limited to natural disasters, government orders, acts of war, labor disputes, or disruptions in shipping or supply chains.


7. Modification of Policy
Bud Bazaar Pro reserves the right to amend or update this Policy at any time. Modifications are effective immediately upon posting to the Marketplace. Continued use of the platform constitutes acceptance of the modified Policy.


8. Dispute Resolution & Governing Law
Any dispute arising from or related to this Policy shall be governed by the laws of the State of Oklahoma. Parties agree to resolve disputes first through informal negotiations. If unresolved, disputes shall be submitted to binding arbitration in Oklahoma County under the rules of the American Arbitration Association.
